of web design and hosting services provided by Wasaga.com

PRICES:

Dear clients,

You will notice a price increase on your 2010 invoices. We do regret this as we have tried awfully hard for years to keep prices as low as possible. Unfortunately, we do have to keep our lights on and our phone connected and we hope you will understand and continue to support us.

We are making many changes to wasaga.com to try to make our services worth every penny. If you have any questions about some of the new features that you see, please click the contact us button and talk to us.

OUR SERVICES
OUR website packages INCLUDE HOSTING. When you become a CLIENT of Wasaga.com, you agree to our service contract. Rates and terms outlined on this page apply only to sites hosted on our servers. We do create websites for hosting elsewhere, only if CLIENT expresses this need in writing, prior to contracting our services. 3rd Party Hosted Sites are a different price and are not bound by this agreement.

CONTENT
Web page design pricing contract assumes that all text is provided by CLIENT in electronic format (.txt, .doc, .wpd, and .rtf) on floppy, e-mail, or retrievable ftp. Text on type pages is acceptable but may be subject to our current hourly fee. All charges will be discussed with CLIENT prior to commencing any job.

All photos and other graphics are to be of high quality print suitable for scanning or electronically available in standard formats including:. JPEG, .GIF, .BMP, .TIFF or Paint Shop Pro native format (PSP). Other forms may be acceptable but with regards to quality and ability to edit are not recommended.

Content must be provided by CLIENT prior to commencing work.

 

EMAIL
Wasaga.com assumes that the CLIENT is familiar and competent with the use of email and does not provide software support for this service. Wasaga.com will provide CLIENT with incoming mail settings.

Wasaga.com exercises no control whatsoever over the content of the information passing through our server(s) but we reserve the right to restrict that which is viewable by the general public and available for download. Wasaga.com makes no warranties of any kind, whether expressed or implied, for the service it is providing. Wasaga.com also disclaims any warranty of merchantability or fitness for a particular purpose. Wasaga.com will not be responsible for any damage suffered. This includes loss of data resulting from delays, nondeliveries, misdeliveries, or service interruptions caused by Wasaga.com.

COPYRIGHT
CLIENT will obtain all rights of copy, Authorizations and permissions for use of text, graphics, and logos. Violation of copyright laws is serious business and every contract of page design; replacement or development will be regarded as a guarantee that such permissions have been obtained. Proof of authorization may be requested by Wasaga.com.

Content is copyrighted to CLIENT, but any custom graphics, databases, php code, digital photography, images which have been created, digitized and/or altered, and HTML coding containing such content is and will be copyrighted to Wasaga.com and may not be distributed, transferred, modified or re-licensed without the express written consent of Wasaga.com.

ACCESSING FILES AND WEBSITE MAINTENANCE
Wasaga.com does not grant publishing (administration) access to the CLIENT via FTP or Telnet for any reason. Access to our web server is restricted to Wasaga.com staff only. Each website is to be exclusively maintained by Wasaga.com unless a specific CMS (Content Management System) is in place for this purpose.  Html website clients are entitled to text updates not exceeding more than 300 words per month at no extra charge. (Free updates do not apply to banner ad, CMS or Wasaga.com Ad customers). Adding photos or creating new graphics are charged at our current hourly rate.

CONTENT MANAGEMENT SITES
CMS sites are created to give CLIENTS safe and secure access to their own websites for the purpose of updating, changing or removing information. For security reasons we cannot grant full administrator access for installation of modules, components, plugins or templates. Any such installations will have to be discussed and approved by Wasaga.com and done by one of our technical staff. CMS sites are created to give CLIENT more control over content. An initial 1 hour training session to instruct CLIENT to make basic website changes is included in our pricing. Further help and support is available by email or telephone at our current hourly rate. 

HOSTING LIMITATIONS
Hosting is limited to text, php, html, flash animation files, Adobe Acrobat (PDF) and images (.jpg, .gif). Other file types such as, but not limited to, Video, MP3's and Software are to be discussed prior to uploading and the appropriate pricing for extra space and bandwidth will be determined. Wasaga.com reserves the right to limit or refuse file types which may stress our bandwidth or server.

REMOVAL RIGHTS
All design Contract Agreements include "on demand" access by Wasaga.com. This Agreement grants Wasaga.com the right to remove any content in part or in full for failure to adhere to the terms of this Agreement including but not limited to violating any licensing agreements or failure to pay fees duly assessed.

DESIGNER "BRAND"
CLIENT agrees that a link will appear at the bottom of the first page on the CLIENT site. Link will be in the form of a very small graphic and/or text link.

RIGHT OF REFUSAL
Wasaga.com reserves the right to refuse service for any content deemed inappropriate, illegal or immoral. 

"SUBMITTED FOR YOUR APPROVAL"
For new websites, Wasaga.com will post all site work done to our server for review by CLIENT. This will allow the CLIENT an opportunity review the appearance and content of scripted material. Unless Wasaga.com is notified via e-mail, or telephone within ten (10) days of posting review Wasaga.com will consider the material deemed acceptable by the CLIENT.

SEARCH ENGINES
Wasaga.com makes no guarantees whatsoever that CLIENT website will be listed by any search engine, directory or list. These are independent companies who operate outside of our control.

SERVICE INTERRUPTIONS
CLIENT acknowledges and agrees that Wasaga.com cannot guarantee constant service because of the variables involved. Circumstances beyond our control, include but are not limited to service interruptions caused by acts of God, telecommunications system failures and server and software problems.

SOFTWARE
3rd Party Software may be used for CGI, PHP, Database, Content Management or E-Commerce Sites. Wasaga.com cannot guarantee or be responsible for 3rd party software. Server upgrades, security patches can sometimes affect performance of 3rd party software, or cause it to stop working entirely.

SUBJECT TO CHANGE
Terms and conditions Agreement is subject to change without prior written notice by Wasaga.com.

GOVERNING LAWS
This Agreement shall be governed by the Laws of the Province of Ontario, which shall claim venue and jurisdiction for any legal motion or claims arising from this Agreement. This Agreement is void where prohibited by law.

ACCEPTANCE OF TERMS
Placing an order with contract the services of Wasaga.com will be regarded as acceptance of the Terms and Conditions. 

FEES
A non-refundable deposit of 50% is required prior to commencing any work. The remaining 50% must be paid within 30 days. A post-dated cheque is preferred. Cash is acceptable providing it is paid before CLIENT website is live. 

Changes, corrections and/or additions will be charged separately and are due upon receipt of the invoice.
